Extra Credit 2/17/14

You have until Friday February 21st to complete this extra credit assignment. Any comments posted after that day will not be accepted.
1. Go to this website and read the information on the three ridiculous lawsuits that are being voted on this month.

2. For each one, identify the plaintiff and the defendant, and summarize the complaint.
3. Choose one of the lawsuits to "judge." With the limited information you have, decide who will win the lawsuit based on the law. You must research and cite specific law/cases to defend your judgement.

  2. ~NASA Failing to Investigate Alien Life~
    Plaintiff - Rhwan Joseph
    Defendant - NASA
    The Mars Rover found a rock that Joseph believed to have alien life form. NASA believed that it was impossible to find any alien life forms so NASA didn't test it. Joseph is suing because NASA won't test the rock.

    ~Coach Sues Player over Celebratory Helmet Toss~
    Plaintiff - Former Coach Alan Beck
    Defendant - Teen's Parents Joe and Reagan Paris
    After a baseball win the 14 yr old allegedly tossed his helmet hitting the coach and tearing his Achilles tendon. The former coach is seeking $500,000 in pain and suffering. And another $100,000 for lost wages and medical bills.

  3. ~Pimp Sues Nike for not warning shoes could be dangerous if used to beat people
    Plaintiff - Sirgiorgio Clardy
    Defendant - Nike Company
    The Pimp was sentenced to 100 years after beating a man with his Nike's shoes. He says that Nike should have put a warning on the product saying that the shoe could be very dangerous when it is used as a weapon. The charges haven't been filed yet. And Nike has not responded.

    There are several cases that are similar to this, that is why I think that this case has a greater chance of winning. For example, The McDonald's Hot Coffee Case. Stella Leiback was awarded $3 million for punitive damages and the burns she suffered. The coffee was at a temperature that could cause second and third degree burns. There is another case were a man suffered third degree burns on his body because he ironed while his clothes were on. He won because there wasn't a label on the iron saying that you couldn't do that.
